Terms of Service

1. Seller Identity

These Terms of Service are between you and JD Data Solutions LLC ("we," "us," or "JobAnalyst"). By using JobAnalyst.io, you agree to be bound by these terms.

2. Acceptance of Terms

By accessing or using JobAnalyst, you agree to these Terms. If you do not agree, do not use the service. If you are using JobAnalyst on behalf of an organization, you represent that you have authority to bind that organization.

3. Product Description

JobAnalyst is an AI-powered service that analyzes resumes against job descriptions. Outputs include ATS scoring, match scores, red-flag detection, recruiter questions, resume rewrites, and cover-letter generation. Outputs are generated by AI and should be reviewed before use.

4. Account Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated.

5. Misuse and Prohibited Use

You may not use JobAnalyst for any unlawful purpose, fraud, spam, IP infringement, security interference (including malware, probing, or scraping), or to generate illegal, hateful, or harmful content. We reserve the right to suspend or terminate accounts for material breach, non-payment, security or fraud risk, or repeated or serious policy violations.

6. Intellectual Property

JD Data Solutions LLC retains all ownership rights to the JobAnalyst service, software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within the limits of your selected plan. You may not reverse engineer, resell, redistribute, or circumvent technical limits.

You retain ownership of your resume and job-description inputs. You grant us a limited license to host and process your content solely to provide the service.

7. Service Level

We do not guarantee uninterrupted or error-free performance. The service is provided on an "as is" basis. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

8. Payment, Credit Packs, and Billing

JobAnalyst is sold as one-time credit packs (Starter, Pro, and Executive). Each pack is a single, one-time purchase that adds analysis credits to your account. There are no subscriptions, no recurring charges, and no automatic renewals. Credits do not expire.

Payments are processed by Stripe. By purchasing, you also agree to Stripe's terms applicable to your transaction. Applicable taxes (such as sales tax, VAT, or GST) are calculated and collected at checkout where required. All purchases are final sale; see our refund policy for details.

9. Termination

Because credit packs are one-time purchases, there is nothing to cancel. You may stop using JobAnalyst at any time; unused credits remain available on your account. We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations.

Upon termination, your right to use the service ends immediately. We may delete your data in accordance with our Privacy Policy.

10. Liability

To the fullest extent permitted by law, JD Data Solutions LLC's aggregate liability is limited to the fees you paid in the prior 6 months. We are not liable for indirect, consequential, or special damages (including lost profits, data, or goodwill), except where prohibited by law. Nothing in these terms limits liability for fraud, death, or personal injury.

11. Indemnity

You agree to indemnify JD Data Solutions LLC against claims arising from your content, unlawful use of the service, or violations of these terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Disputes shall be resolved exclusively in the state and federal courts located in Texas.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the revised Terms.
